The purchase of products in the Livine Online Store is subject to the following terms and conditions:
1. Object
1.1 The present General Conditions in force are intended, together with the order form and other elements referred to therein, to regulate the terms and conditions that govern the provision of the Service in the Livine Online Store.
1.2 The purchase of any product in the Livine Online Store implies acceptance of these General Online Sales Conditions.
1.3 Access to the Livine Online Store is free of charge and does not require prior subscription or user registration.
1.4 Alcoholic beverages available for sale in the Livine Online Store may only be purchased by individuals of legal drinking age in their country of residence.
2. Product Information, Prices and Content
2.1 Livine reserves the right to modify, without prior notice and at any time, the information and commercial offer presented regarding: products, prices, promotions, commercial conditions and services.
The images illustrating each product on Livine may differ from the product subsequently delivered.
2.3 The items for sale in the online store are subject to existing stock and orders will be processed on a first-come, first-served basis. In the event of a temporary or permanent stockout, the customer will be duly notified, and an alternative of products with similar characteristics will be suggested.
2.4 Under Portuguese legislation, product prices are indicated in € (Euros) and include VAT at the legal rate in force, as well as packaging costs. Transportation costs for the customer are not included.
3. Order and Payment
3.1 To make a purchase in the Livine Online Store, the user should ideally register as a customer. Once registered, the user can place their order by selecting the desired products. The user must follow all steps described therein for the order to be successfully finalised.
3.2 After confirming the order in the Livine online store, the user must select the desired payment method from the available options: Multibanco, Visa, Mastercard, Paypal, among others. Any order placed in the Livine online store will only be processed after the effective receipt of payment. The formalisation of the order alone does not constitute a reservation of the products.
3.3 After confirming the order in the Livine online store, an email will be sent to the contact address registered by the customer upon formalisation, containing all details regarding delivery, invoicing and payment information. If the customer does not receive the order confirmation email, they are requested to contact Livine via email at info@livine.eu.
3.4 Changes to the conditions of orders not yet dispatched, or the cancellation of an order not yet dispatched, may be made when requested via email to info@livine.eu.
3.5 Orders placed by users from countries outside the European Union must be validated in advance.
3.6 Orders will only be shipped after confirmation of stock and payment and will be processed on a first-come, first-served basis.
3.7 If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by Livine.
3.8 After receiving the order data, the user has 3 business days to make the payment. If payment is not made within this period, the order will be automatically cancelled.
3.9 The Livine Online Store offers the user the possibility to pay by bank transfer; to do so, please contact us via email at info@livine.eu.
3.10 Proof of bank transfer must be sent to the email info@livine.eu.
3.11 Payments are received in Euros, regardless of the currency in which the transaction is made. Conversion rates for payments made in other currencies must be borne by the customer.
4. Shipping Costs
4.1 Shipping costs are calculated based on the weight of the products, destination and the total value of the order.
4.2 Shipping costs are indicated in the shopping cart before the final validation of the order, for deliveries to Mainland Portugal. For deliveries outside Mainland Portugal, the total shipping price is calculated after the customer’s order confirmation via email to info@livine.eu.
5. Delivery
5.1 Orders will only be shipped after confirmation of stock and payment and as soon as possible.
5.2 Orders will be delivered to the address indicated by the customer and in accordance with the delivery times of the carrier company. Home delivery cannot be made to P.O. Boxes (Apartados). Deliveries may be made outside Mainland Portugal, provided the address is within the carrier’s delivery area.
5.3 As the transport service is contracted to a third-party company, possible delivery delays cannot be resolved by Livine, and in such cases, exact delivery times cannot be guaranteed.
5.4 If for any reason the customer cannot receive the order or pick it up at the location indicated by the carrier, the customer is requested to contact the Livine Online Store immediately via email at info@livine.eu.
5.5 All products sent by Livine must be checked upon delivery. If the customer verifies that the order is damaged, they must return it immediately to the carrier company, indicate the reason for the return on the delivery note/waybill, and immediately inform the Livine Online Store via email at info@livine.eu.
5.6 If, after delivery, the customer verifies that any of the items are not in conformity, they are requested to contact Livine immediately via email at info@livine.eu, indicating the order number or the number of the document accompanying the order, attaching images of the packaging as received and of all items, so that the situation can be resolved as quickly as possible.
6. Returns/Complaints
6.1 The Livine Online Store allows the return of products within a period of 15 days from the date of receipt of the order.
6.2 To request an exchange or return, the customer is requested to contact Livine via email at info@livine.eu, indicating the invoice number.
6.3 The return of defective products and incorrect shipments is the responsibility of Livine, as well as shipping and collection costs, provided the customer communicates this situation within 15 (fifteen) days from the date of receipt of the product. Once the merchandise is received at our facilities and its condition is validated as compliant, its value will be refunded.
6.4 Livine is not responsible for deficiencies resulting from incorrect use, negligence and poor storage conditions by the Customer.
7. Alteration of Sales Conditions
These general online sales conditions may be changed without prior notice and should therefore be consulted before placing any order.
8. Data Protection
The Customer must expressly declare that they authorise the collection or update of their contact data for integration into Livine’ files for the purposes of customer management, commercial relations, as well as for sending advertising about products and services under Law no. 6/99, Law no. 41/2004 and Directive no. 2002/58/EC, through automated processing and profiling, via all available communication channels, including electronic means. Express consent must be given when registering in the Online Store, in the option indicated for this purpose. The contact data collected will be kept for the period during which the purpose for which its processing was consented to is verified, or until the exercise of the right of opposition, rectification and erasure thereof. The data subject has the right to access the stored data free of charge, as well as to request its limitation, rectification, opposition or erasure when, among other legal grounds, the contact data is inaccurate or no longer necessary for the purpose that motivated its collection. The holder also has the right to withdraw their consent at any time, without compromising the lawfulness of the processing carried out based on the consent previously given. If technically possible, the data subject may request the portability of their data to another data controller, in which case they will only be kept for the exercise or defence of claims. When any of the aforementioned rights are exercised, we reserve the right to keep the data exclusively for the purposes of declaration, exercise or defence of a right in judicial proceedings. To exercise these rights or for other additional questions regarding data protection, you may contact Livine in writing via email at info@livine.eu, and must proceed with authentication and proof of identity of the data subject. We also inform you that you may lodge a complaint with the National Data Protection Commission (CNPD) if you consider that your rights have not been duly addressed. For more information, please consult: https://www.cnpd.pt/. Livine does not transfer collected contact data to third parties. If there is a legitimate ground for its transfer, the Customer will be informed in advance, and the identity of the recipients and the purpose of the processing of the transferred data will be transmitted. The transfer occurs only when third parties present sufficient guarantees of the execution of appropriate technical and organisational measures, so that the processing satisfies the requirements and obligations arising from the applicable legislation on data protection and ensures the defence of the data subject’s rights.
9. Declaration of Liability
Livine expressly declares and guarantees that:
a) It will adequately handle the Personal Data it collects from its Customers within the scope of the Online Store Service provision; that these will be subject to lawful, confidential, fair and transparent processing, and in a way that guarantees their security, namely undertaking to protect such Personal Data against accidental or unlawful destruction, accidental loss, alteration, unauthorised dissemination or access;
b) It is in a position to ensure all appropriate technical and organisational measures so that the processing of Personal Data satisfies the requirements of the current Personal Data Protection Law, approved by Law no. 67/98, of October 26, and by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016, (“GDPR”), which entered into force on May 25, 2018;
c) The Personal Data is intended solely for the execution of orders placed in the Online Store, being collected only as necessary, appropriate, relevant and limited to that purpose;
d) It will keep Personal Data accurate and up to date;
e) It will not use the Personal Data to which it has access for any purpose other than that provided for in these Terms and Conditions; f) At the Customer’s request, it will destroy said Personal Data immediately and efficiently.
